Part 1: We talk with Carissa Byrne Hessick, who is the Ransdell Distinguished professor of law at the University of North Carolina School of Law, where she also serves as the director of the Prosecutors and Politics Project. She is the author of Punishment Without Trial: Why Plea Bargaining Is a Bad Deal. We talk to her about plea bargaining, trials, sentences, the power of judges and prosecutors. Of the people who are accused of crimes, 97% plead guilty, and bargain with the prosecutors. Therefore, prosecutors decide to prosecute a person, negotiate the plea bargain (including the penalty), and conditions, all without a trial or any “interference” from a judge, much less a jury. The concept of trials is therefore against the right to a trial in the Constitution. We have a discussion of the issues raised, and the outcomes. Part 2: We talk to Slate.com's Henry Grabar about DeSantis's fight with Disney and how it will affect Florida.Disney has a debt of at least $1 B, which will have to be assumed by the county and state. In addition, it is not clear if it will stand, since we expect challenges to the new policy by the governor. We also discuss the practice of city design that is different in the US and Japan. In Japan, children are raised to be more independent of their parent than in the US, and are often encouraged to run errands and be outside than American children. This is due to several factors: neighborhood schools closer to homes, traffic is much different (no street parking), and mixed-use neighborhood planning.
